论房屋征收补偿制度的问题及对策

摘要
《国有土地上房屋征收与补偿条例》以"征收"替代了原来规定的"拆迁",对房屋征收和补偿工作进行了重新定位,"以规范公权力,保护私权利"为目标,注重征收补偿工作中的公平合理。然而,新条例对房屋征收补偿的原则性规定,也使得公共利益、征收程序、补偿范围、救济制度等重要问题并不具备明确性和可操作性。为了实现立法目的,当前亟需对此进行完善。
In the Regulations on the Expropriation of Houses on State-owned Land and Compensation,the word"demolition"was replaced by"expropriation",which re-defined the works of housing expropriation and compensation,to the aim of regulating public power and protecting private rights.But on many aspects,the new regulation only made principle provisions,which made many important issues such as"the public interest","the expropriation procedure","the scope of compensation","the relief system" unclear and not operational.In order to achieve the purpose of legislation,we must try to improve the regulation.
