破垸还湖后的梁子湖立法研究

摘要
梁子湖主动破垸还湖,并实行永久性退垸还湖,是长江经济带建设中以生态优先、绿色发展理念应对特大洪水的标志性事件。梁子湖立法是贯彻湖北湖泊立法战略的关键,破垸还湖凸显了其紧迫性。破垸还湖后梁子湖立法面临适用范围、生态移民与生态补偿等新问题。建议梁子湖立法树立"保生态"的立法理念,并构建富有特色的核心制度体系,为新形势下全国的湖泊立法提供借鉴。
It is a remarkable event that Liangzi Lake Administrative Authority has taken an active action to break the embankment and retreating the flood storage perpetually in the spirit of the ecological protection primarily and green development in the course of building Yangtze River Economic Belt. Law-making of Liangzi Lake is the key to carry out the strategy of Hubei Lake protection-legislating, Breaking the embankment and retreating the flood storage embodied the urgent situation of protecting the lake. There are some new legislation concerns including the scope of law, eco-migration, eco-compensation after Liangzi Lake was broken the embankment and retreating the flood storage. Suggestions are that the law-maker of Liangzi Lake persist in the spirit of protecting the ecological system, constructing the unique key systems, and so that it will be a reference while the whole national lake legislation.
