海上安全与贸易自由:港口国监控制度与海运服务贸易的冲突与协调

摘要
港口国监控制度在维护船舶安全和海洋环境保护等方面发挥着积极作用,其在船旗国履约制度之外筑起了保障海上安全的第二道防线。然而,秉承海上安全价值的港口国监控制度在对推崇贸易自由价值的海运服务贸易进行良性指引的同时,不免在效率、自由化、国际社会公平参与等方面与海运服务贸易产生一系列的冲突。基于此,以可持续性的视角审视港口国监控制度的功用、建立甄别港口国监控制度合理性与正当性的标准,同时加大海运发展中国家在世界体系中的话语权等均是协调港口国监控制度与海运服务贸易关系的可行路径。
The system of port state control plays a positive role in shipping safety, and marine environment protection which builds the second line of defense besides performance system of flag state. However, while the system of port state control which following the principle of maritime security is giving a well guide for the marine transportation service which following the principle of trade freedom, the system of port state control conflicts with the marine transportation service in efficiency, freedom, equal participation of international community and other aspect . Therefore, scanning the effort of port state control from a sustainability perspective, building the standard of examining the rationality and legitimacy of port state control, increasing the discourse power of the marine developing countries in the world system are the feasible method for coordinating the relationship between the system of port state control and maritime transportation service.
