司法鉴定人出庭制度研究

摘要
司法鉴定人出庭参与质证是解决司法鉴定争议的途径之一,但其出庭率过低却困扰着法庭审判;民事、刑事诉讼法对出庭作证都有进一步的规定,但相关法律规定却原则而笼统,对其具体权利及出庭所涉及的其他法律问题并没有进一步规定,导致司法实践中缺乏可操作性。文章提出明确鉴定人的权利和义务、对其出庭进行经济补偿及必要的司法保护,来完善司法鉴定人出庭制度,以便更好地解决司法鉴定争议。
It is one of the ways to resolve judicial appraisal disputes for judicial appraiser to appear in the cross-examination in court,and appraisers'low court appearance rate has always puzzled the court trial.The civil and criminal procedure law has further provisions on appraisers'court appearance in court,but the relevant legal provisions are general in principle,and there are no further provisions on the specific rights of appraisers and other related legal issues,which results in a lack of operability in judicial practice.Therefore,this paper proposes that the rights and obligations of the appraiser should be clearly defined and the appraisers should be given economic compensation and necessary judicial protection for their appearance in court.And in this way,the system of judicial appraiser's appearance in court can be improved and the dispute of judicial appraisal can be solved better.
