摘要

惩罚性赔偿制度的发展一直伴随并推动着社会的进步。近年来,我国的惩罚性赔偿制度正步入深入发展的重要关口,传统的立法思维已经逐渐滞后,在预防、惩罚两大主要功能的驱使下,应当逐步探索突破惩罚性赔偿金最高数额的限制,以实现社会各方的利益平衡。
        The development of the punitive damages system has been accompanied by and promoted the progress of society. In recent years, China's punitive damages system is entering an important barrier of in-depth development. The traditional legislative thinking has gradually lagged behind. Under the drive of the two main functions of prevention and punishment, we should gradually explore the limitation of breaking the maximum amount of punitive damages. To achieve the balance of interests of all parties in society.
