理念转变与规则调整:涉毒犯罪的网络异化及其刑法应对

摘要
互联网的虚拟性、便捷性和大数据时代的即时聚集效应,使网络社会中的涉毒犯罪活动呈现出犯罪数量不断激增、犯罪人数急速增长、犯罪年龄呈低龄化、犯罪破坏性急剧扩张等特征。目前,学界对互联网吸贩毒"聊天平台"的定性存在辩争,因而极有必要扩大解释容留他人吸毒罪,以约束网络涉毒组织行为。此外,共犯中的组织犯和帮助犯在互联网中出现了异化,相较于传统犯罪主犯,组织犯作用在递减,较之传统犯罪从犯,帮助犯作用在递增,因而必须从严打击互联网涉毒犯罪的帮助犯,并对借助互联网实施涉毒犯罪人员增设资格刑。针对互联网新型毒品犯罪的法律缺漏,需要增设组织吸毒罪、传播毒品信息罪,强化对毒品犯罪源头和消费行为的打击。
The virtual nature of the Internet, the convenience and the immediate gathering effect of the big data age make the drug-related criminal activities in the cyber society more harmful than the real social drug crimes. It shows that the number of crimes is constantly increasing, the number of crimes is increasing exponentially, the age of crimes is low, and the crime is rapidly expanding. At present, the academic circles argue over the characterization of the "chat platform owner" of Internet drug trafficking. Therefore, it is extremely necessary to expand the interpretation of the crime of allowing others to use drugs in order to restrain the behavior of Internet drug abuse organizations. In addition,there has been alienation in organizing and helping accomplices on the Internet, and the role of organizing criminals is decreasing compared with that of leading criminals in traditional crimes, and the role of assisting criminals is increasing compared with that of assisting criminals in traditional crimes. Therefore, it is necessary to strictly crack down on aiding criminals in drug-related crimes. And the use of the Internet to carry out drug-related crimes to increase the number of qualified punishment. In view of the gaps in the law on new types of drug crime on the Internet, it is necessary to increase the crime of organizing drug use and spreading drug information, and strengthen the fight against the source of drug crime and consumer behavior.
