“一带一路”建设中的知识产权保护策略

摘要
在当前知识经济化和经济全球化的背景下,知识产权已成为国家或企业的核心战略资源和关键竞争力量。而"一带一路"国家知识产权制度的不同,阻碍了相互之间经贸合作的深度和广度,弱化了知识产权在"一带一路"建设诸多推动力量中的优先地位。且该类矛盾的存在,势必会影响国家间的其他正常合作,故需要构建和完善知识产权的立法、司法、执法和守法等立体化法治规制机制,为我国与"一带一路"国家开展更好的国际经贸合作奠定基础,助推"一带一路"发展规划的顺利实施。
Under the background of knowledge economization and economic globalization,intellectual property rights have become the core strategic resources and key competitive forces of countries and enterprises.The intellectual property systems differ in "Belt and Road" countries,hindering the depth and breadth of economic and trade cooperation between China and these countries.It weakens the priority of intellectual property rights in promoting the construction of "Belt and Road".And the existence of such contradictions will inevitably affect other normal cooperation among countries.Therefore,it is necessary to construct and perfect the three-dimensional legal regulation mechanism of intellectual property rights such as legislation,judicature,law enforcement and law-abiding.It will lay the foundation for China and "Belt and Road" countries better development of international trade and economic cooperation,and smooth implementation of boost"Belt and Road"development planning.
