摘要

韩国通过韩美自贸协定引入了药品专利链接制度。韩国制度在框架上与美国类似,但在具体制度细节上则根据其本国相关法律制度和国情进行了较大的调整。本文对韩国药品专利链接制度具体内容和相关实践情况进行了分析,并在此基础上对我国拟探索建立的相关制度提出了建议。
        Patent linkage system was introduced into South Korea through the Korea-US Free Trade Agreement. The Korean system is similar to that of the United States in its framework, but in terms of details, it has undergone adjustments in accordance with its relevant legal system and national conditions. The paper, based on analysis of the specific content and related practices of the patent linkage system of Korea, presents suggestions for the future establishment of drug patent linkage system in China.
