摘要
《大宪章》八百年来对英格兰乃至世界宪政都产生了巨大影响,但自近代以来对《大宪章》的批评一直不绝于耳,《大宪章》越来越被认为是一个"神话",而缔造这个"神话"的"元凶"则公认为爱德华·柯克爵士,那么柯克爵士究竟是否缔造了一个不可复制的"神话",他对《大宪章》的解释又是否如时人所称那样不堪一击呢?本文试从英国普通法的语境入手,介绍并分析柯克对于《大宪章》的解释,并试图证明柯克对于《大宪章》的解释乃法律技术的问题,其所用之方法乃制定法解释的惯常之法并无"神话"之问题。本文首先介绍了《大宪章》及对其之批评,柯克对于《大宪章》解释及对其之批评,其次,本文从法律解释的角度入手,列举案例并引出英国语境下的制定法解释及其渊源——衡平规则,再次,本文分析了柯克是如何运用这一规则解释《大宪章》并将其"带出中世纪"的,最后,本文分析并试图论证《大宪章》神话于法律语境和制定法解释之语境而言实乃值得商榷之事。
