农民工的权益与社会保障探析

摘要
近几年,在农村推力和城镇化拉力的双重作用下,越来越多的农民进城务工,他们为“三农”问题的解决和城市化、工业化的发展做出了巨大的贡献。但是,由于城乡分割的“二元社会”以及与之对应的“二元就业结构”的存在,农民工身份的转换滞后于其职业的变换,农民工作为新的产业工人的身份没有得到广泛的认同,致使他们长期游离在城乡之间,成为不受保护的“边缘人”,也使得他们被排除在应有的社会保障体系之外。
     农民工应有的权益得不到保障将影响到他们自身的生存和发展,将影响到农村及城镇的经济发展,影响到社会的稳定和社会保障公平的本质,因此建立面向农民工社会保障制度势在必行。
     在现有财力和技术条件下把农民工纳入城镇社会保障体系或建立一个全新的农民工社会保障体系并不可行性,因此本文提出了“一元化目标,多元化过渡,分类分层保障农民工利益”的思想,指出现阶段应该把农民工根据职业特点、流动性程度以及收入情况分类,按照他们需求的轻重缓急,分阶段、有步骤地建立有针对性的农民工社会保障体系。文章还设计了建立农民工工资支付保障制度、农民工工伤保险、失业保险、医疗保险、养老保险以及“公共劳动”形式的最低生活保障制度的构想,并提出农民工社会保障基金筹集及农民工社会保障的监督执行的办法。
In recent years, more and more farmers go to cities to find job under both the pressure of counties and the pull of urbanization, that contributes a lot to the solve of many problems, including problems of "agriculture, farmers, counties", urbanization and industrialization. However, because of the existence of rural-urban divided dualistic society and corresponding dualistic employment structure, the transition of identity of farmer labors lagged behind the transition of their occupation, and the visualization of farmer labors, as new industries' workers have not been widely recognized yet. So they are always dissociated from both counties and cities and becoming "fringe people" without protection who are excluded by the current social security system.
    It is imperative under the situation to establish a farmer labors oriented social security. Otherwise, if the rights they should have can not be guaranteed, it will not only do harm to the survival and grow of the farmer labor group themselves, but also hinder the economic development of counties and towns, as well as the stabilization of society and essence of equity of social security.
    It is not viable under current technological and financial status whether to bring farmer labors into urban social security system or to establish a brand new one for them own. Therefore, this article brings forward the thought of safeguarding the interests of farmer labors step by step with centralized objective and diversified transition. Meanwhile, it points out that the farmer labors should be classified into several types by their occupation character, flowing rate and income levels so as to establish pertinent social security system in phases in the light of their different degree of requirement. This article also advances new ideas of series of security systems on wages and salaries payment, labor injury insurance, unemployment insurance, medical treatment insurance, retirement pension insurance, and the lowest living security system of public work. Furthermore, the article formulates some methods on fund raise, supervision and enforcement of farmer labors' social security.
