国际工程合同管理与索赔

摘要
本文首先介绍了国际工程的概念及特点，它既包括我国公司到海外参与投资和实施的各项工程，也包括我国境内进行国际性公开招标由国际组织和国外的公司到中国来投资和实施的工程。阐述了在当今的国际、国内形势下，尤其是我国已加入WTO，我国的工程项目管理加快与国际接轨变得迫在眉睫。
论述了在国际工程项目管理中合同管理和索赔的地位与作用，介绍了在国际工程项目管理中合同管理与索赔的主要工作内容、工作程序及一些技巧，指出了在这些繁琐、复杂的工作中应注意的问题。
通过分析我国工程建设领域合同、合同管理及索赔现状，找出了存在的问题及原因。结合国际工程中合同管理与索赔的成熟经验，提出了解决问题的方法与措施。
论文最后通过黄河小浪底水利枢纽工程中合同管理与索赔这一具体案例的分析，再一次证明了只要我国的工程建设主体按现代企业制度进行管理，真正实现与国际惯例接轨，严格实施项目业主负责制、建设监理制、招标承包制，按照FIDIC合同条件进行项目管理，采取措施保证监理工程师的地位和权利，并不断提高监理工程师的水平，我国的工程项目管理水平将会得到更大提高，工程项目在建设周期、工程质量和投资控制等方面均会收到理想效果。
This article introduces concept and its characteristics of the international projects, which include various projects abroad that Chinese companies invest or participate in and also include those invest in China by foreign companies or international organizations and publicly bided. The essay addresses that Since China having entered into WTO, ft is utmost urgency for Chinese companies to manage projects in accordance with the international codes and customs.
The author discusses the roles and functions of contract management and claims in managing international projects, introduces main work scopes, procedures and skills of contract management and claims in managing international engineering, points out the particulars that should be noticed when dealing with the complex works mentioned above.
Through analyzing at present situation of civil construction industry of our country, the author discloses some current problems and brings out a few methods and measures for resolving these problems.
Taking the case of contract management and claims of Yellow River Xiao Lang Di Dam Project as an example, author illustrates again the importance for enterprises in our country to establish modern business enterprise system and run project according to international codes and customs.
论述了在国际工程项目管理中合同管理和索赔的地位与作用，介绍了在国际工程项目管理中合同管理与索赔的主要工作内容、工作程序及一些技巧，指出了在这些繁琐、复杂的工作中应注意的问题。
