论诱惑侦查

摘要
诱惑侦查是刑事诉讼中的一种特殊的侦查手段。诱惑侦查在美国、英国、德国、日本等国家的侦查实践中被广泛地运用。其合法性得到国家的认可。借鉴国外的法理和实践，从侦查目的、侦查模式、打击犯罪和保障人权的需要、道德支撑及法治化要求的角度，分析了我国诱惑侦查的合法性。将是否诱使他人产生犯意作为划分诱惑侦查的合法性的界限。认为“机会提供型”诱惑侦查合法，而“犯意诱发型”诱惑侦查非法。主要从程序法，兼从实体法，司法解释等方面提出了我国诱惑侦查制度的初步立法构想，认为有必要从诱惑侦查的适用原则、范围、对象、法律监督以及违法诱惑侦查的法律效果等方面对诱惑侦查进行评价和规制。将我国的诱惑侦查纳入法制的轨道。
A special means in criminal procedure,the encouragement detection is extensively used in procedural practices of the United States,Great Britain,Germany and Japan,the state organs of which have approved its validity. In view of the foreign legal principles and practice,this paper summarizes the purpose of the detective investigation,common ways of practice,needs to crack down the crimes and guarantee of human rights,moral support and legal demands. The paper also analyzes the validity of the encouragement detection,and holds that the "entrapment detection" its invalid,and believes that the detection of "opportunity encouragement" is legal,and the "entrapment detection" is illegal. The paper also puts forward the relevant initial legislative proposal from the perspective of the procedural law" as well as the criminal law and judicial interpretation,stating the necessity to assess and regulate the applicable principles,scopes,targets,legal supervision,analyzing the legal effect of the encourage detection,and e
xpecting to legalize such practice in China.
