辽河油田补赔偿工作伦理案例研究

摘要
辽河油田是以石油、天然气勘探开发为主、油气深加工等多元开发为辅的大型联合企业,在勘探生产过程中经常遇到施工现场周围的群众、企业以生产设备、设施产生噪音震动影响休息、养殖等原因,向油田索要正常或非常的补赔偿,甚至个体或群体采取堵路等过激方式进行,严重阻碍油田生产,破坏了社会风气,影响社会和谐。
     虽然政府、辽河油田坚持以人为本原则,采取各种措施减小影响,分考虑受影响群众、企业的诉求,在合理合法的基础上,尽最大努力满足受影响群众、企业的愿望,争取和谐友好解决处理因补赔偿问题引起经济纠纷,但由于目前为止无论是企业、还是政府,没有符合油田补赔偿问题工作需要的、系统的、简洁明了的、权威的补赔偿标准与细则,且此类问题多是群体行为,致使在协调处理补赔偿问题时常常形成法不责众的局面。即使动用警力干预,也由于依据不足而使法律显得苍白无力。
     因此,开展伦理道德教育,建立良好的社会道德秩序,建立适合辽河油田补赔偿工作的、权威的补赔偿标准或细则,完善补赔偿行为规范,加强法律制度约束机制,是高效快速、公平公正、合理合法解决油田生产的补赔偿问题的当务之急。通过建立标准和伦理道德教育,达到保护各方利益、保护国家能源安全和构建和谐社会的目的。这不仅是辽河油田生产经营的需要,亦是保护国家能源安全和构建和谐社会的需要。
     本文从辽河油田补赔偿问题的产生及现状入手,采用案例分析的办法,找出辽河油田补赔偿工作中所涉及的伦理问题。探索运用伦理学理论,提出了相应的解决办法,指导辽河油田补赔偿工作。希望本文能对今后类似的问题起到参考、借鉴的作用。
     全文共分四部分。第一部分引言,第二部分企业简介与案例,第三部分案例分析,最后是结论部分。
Liaohe Oilfield Company is a large integrated enterprise which puts effort into petroleum exploration, development and further procession as supplementary. There sometimes are of trouble that the citizens or companies surrounding the working field always ask normal or abnormal compensation for detrimental effect, which is mainly caused by the noise and shaking equipments and facilities during the procedures of drilling, to rest, cultivation and so on. What's more, taking radical action, such as blocking the road, will hinder the production of the oilfield, and bring serious influence to social morality which would undermine the harmony of our society.
     Based on principles of human-oriented and laws, the government and Liaohe Oilfield Company adopt various measures to deal with the economic disputes which are caused by problems of compensation friendly, and make their great effort to satisfy the desire of the effected masses and companies in order to have a minimal impact. However, whether the government or company seems powerless because the lack of a set of systemic, brief, clear, and authoritative criterion. Furthermore, such issues are present in form of group behavior, and the law does not punish everybody.
     As a matter of fact, the discussion of compensation is the process of reallocation of the interests. For the difference of inner quality, interest representation, working capability and credit among parties involving the procedure of handling the compensation trouble, various results will come out for a same problem without a set of authoritative compensation criterion, which leads to comparing of influenced masses and companies.
     This article makes up the compensation question from the Liaohe Oilfield Company the production and present situation obtaining,Uses the case analysis the means, Discovers the Liaohe Oilfield Company to make up ethics question which in the compensation work involves. Exploration utilization ethics theory, Proposed the corresponding solution, Instructs the Liaohe Oilfield Company to make up the compensation work. Hoped this article will be able to play the reference to the next similar question, the model role.
     This paper consists of four parts. Part one is introduction. The second part Company and Case ,The third part of case analysis, The last part is the conclusion.
