我国农村生态环境的法律保护研究

摘要
自20世纪70年代以来,随着农村人口的快速增长和农村经济的不断发展,农业综合开发规模和乡镇工业对资源的利用强度日益扩大,农村生态环境问题越来越严重,以成为我国环境问题的一个重要方面。解决好农村生态环境问题不仅有利于我国环境保护事业的发展壮大,还有利于我国社会经济的持续、稳定、健康发展。
本论文从我国农村生态环境问题的现实形势入手,分析了具体存在的法律问题,并指出在诸多影响我国农村生态环境问题恶化的原因中,农村生态环境立法保护不完善、执法中法律依据不明确、监督管理不到位、农民生态环境保护法律意识薄弱等是导致我国农村环境问题恶化的直接的、现实的、主要的原因。本文在具体分析我国农村生态环境法律现状的基础上,借鉴发达国家的先进经验,提出了一些有利于我国农村生态环境法律保护的构想。当然,影响我国农村环境问题恶化的原因是多方面的,有社会方面的原因,政策方面的原因,观念方面的原因等,更有法律方面的原因。从长远来看,只有将农村生态环境纳入法制化轨道,充分发挥法律在农村生态环境方面的预防作用、救济作用、惩治作用,才能保护农村的生态环境,才有利于农村的和谐发展。我国农村生态环境问题是一个高度复杂的问题,它的解决任重而道远,需要我们给予更多的关注,投入更多的人力、物力和财力,农村环境保护工作是一项系统工程,需要在长时期内不断推进。
Since the 70s of the 20th century, with the rapid growth of population and continuous development of economy in rural areas, the scale of the comprehensive agricultural development and the intensity of the use of resources are increasingly expanding. At the same time, the eco-environmental problems are getting worse and has become an important aspect of the environment. Solving the rural eco-environmental problems is in favor of not only the development of environmental protection cause, but also good to the sustainable, stable and healthy development of society and economy.
In this paper, specific legal issues are discussed from the situation of today's eco-environmental problems in our rural areas. It also points out that there are many reasons for the deterioration of rural eco-environment. Among them, the direct, practical and principal reasons are: the imperfect legal protection of rural eco-environment, the indefinite legal basis during enforcing law, the immature supervision and management, and the peasants' weak awareness of eco-environmental protection law. This paper specifically analyzes the present situation of today's rural eco-environmental law. On the basis of that and with the advanced experience of developed countries, it proposes some ideas in favor of the rural eco-environmental legal protection. Of course, the reasons for the deterioration of our rural environment are various. Apart from the aspects of society, policy, realization and so on, there are legal reasons. In the long run, the rural eco-environment can be protected and the harmonious development in rural areas can be better realised only when the rural eco-environment is incorporated into legal system and thus law plays a full role in the aspects of prevention, relief, punishment in order to protect the eco-environment in rural areas. The problem of the rural eco-environment is highly complicated. So, to the realization of its solution, we have a long way to go. We should pay more attention to it and provide more human, material and financial supports. The protection of the rural environment is a systematic project. Therefore, it is necessary for us to constantly push it forward in a long time to come.
