我国法律框架下Partnering模式结合其他承发包模式的应用研究

摘要
Partnering模式是于20世纪90年代初期在美国产生的一种新的工程承发包和管理模式,至今已在美国、英国、澳大利亚、新加坡、香港等地得到了广泛的应用。Partnering模式创造了一种和谐的项目环境,改善了业主和承包商之间的关系,并在降低工程费用、缩短建设周期、提高工程质量、减少工程争议方面产生了明显的效益。
     本文首先全面阐述了Partnering模式的理论基础以及组织结构、实施流程等内容,说明该模式的运行机制、主要特点以及能够为项目实施带来的效益。然后在我国现阶段招投标法等相关法律法规的框架下,从法律制定的基本点出发,就该模式如何与我国法律有机结合的方式进行研究。再在对我国目前应用较广泛的工程项目承发包模式特点进行具体分析的前提下,探讨了Partnering模式具体应用在这些承发包模式中的方法。然后结合国外应用的Partnering协议以及我国的工程实际,拟定适用于我国工程项目的Partnering协议。最后通过结合实际工程项目的研究,对前面提出的观点进行了改进,以求理论与实际能够更好地统一,并就该课题的延伸作了一定的展望和建议。
Partnering is a kind of construction project contracting and management method, originated from the U.S.A. in the early 1990. It has been applied widely in U.S.A., England, Australia, Singapore and Hong Kong. Partnering creates a harmonious environment in construction projects and benefits the owner and contractor much in saving cost and time, improving quality and reducing disputes.
     This paper summerizes the theoretical principle of Partnering and it's organization structure and operating flow firstly, explains the working mechanism and the benefits of Partnering. After that, this paper concerns how to practice Partnering from view of lawmaking in the legal frame of construction industry at the present stage in China. Then, after analyzing the contract modes mostly applicated in our country, this paper studies on how to combine Partnering with these contract modes more perfectly. And then, it makes a propose of Partnering chart of China after serious study on those successful Partnering charts which were used in other countries. Finally, this paper studies a practical case, and improves the viewpoints to make them more suitable for practice, and makes some suggestions of issues which need more attention.
