国防专利归属制度研究

摘要
随着新《国防专利条例》的颁布,之前专利权权属统一国有的模式被打破,主体多元化的趋势成为必然。国防专利是特殊的专利发明,其归属制度集中体现了国防安全战略和国防经济利益的需求。国外军事强国在国防专利制度构建上大多采用了“放权原则”,即专利权一般情况下归研究方所有,国家享有一定的使用优先权的方式。我国目前仍然处在理论有待明确的阶段,总体上还是按照计划经济时代的国家所有的思想指导工作。在实践中,由于法规体系、管理机构、人才培养等方面需要完善,存在诸如“二次付费”问题、军工企业归属及职务发明等直接而现实的问题。本文将从国防安全战略、经济学视角、比较法学、法理学角度对归属制度的理论构建进行分析,并结合实际中存在的问题提出相关的改进建议。
With the new "National Defense Patents Ordinance" enacted, the model of State have the ownership of the national defense patent is broken, and the diversification of main has become an inevitable trend. National defense patent is a special patented invention, the concentration of ownership of the system reflects the national security strategy and national defense interests of the economy. The world's major military powers adopt the "principle of decentralization”in building on defense of the patent system. That means, under normal circumstances, the ownership of the national defense patent attributed to researcher, at the same time, State enjoy a part of priority in usufruct. At present, the defense patent theories have not form a conclusion in Chinese academics. On the whole, the thinking of the ownership of national defense patent attributed to State is still the guiding principles on work in national planning economy age. In practice, there are some direct and real problems such as "second payment", military enterprises and service invention, because of the legal system, administration, personnel training were not perfect. This article analysis the system of the attribution of national defense patent building, combined with the actual problems that exist in forward proposals to improve, from the national security strategy, economics perspective, Comparative Law and Jurisprudence perspective.
