第二船籍登记制度相关法律问题研究

摘要
第二船籍登记制度是当代一种新型的船舶登记制度,它在船舶登记条件、船舶税费征收、船员配备条件、船舶安全标准的适用等方面自成体系,与原有的封闭登记制度和开放登记制度相区别。它是在不改变原有的传统船舶登记制度的前提下,由船旗国政府制定并与原有的传统船舶登记制度并行实施。众多传统海运国家的实践证明,第二船籍登记制度有效解决了航运经济发展、海上人命和财产安全、海洋环境保护等问题,缓解了方便旗对传统海运国家的冲击。
     为促进中国航运经济持续、快速、健康发展,亟需调整航运业的结构。第二船籍登记制度乃是改善目前我国方便旗船舶比例失调、调整我国国际运力结构的有效法律制度,是我国航运业结构调整取得成功的有效法律保障。在洋山保税港区建立起第二船籍登记制度既是航运业发展的迫切需要,又具有深远的意义。本文在分析、借鉴国内外相关法规、公约和制度的基础上,探索了洋山保税港区建立第二船籍制度的相关法律问题,为促进上海国际航运中心的形成提出立法建议。
     本文共分四章:第一章主要论述了第二船籍登记制度的产生和发展,包括船舶登记制度概述、第二船籍登记制度的产生和发展、第二船籍登记制度产生缘由。第二章主要论述了国内、国际相关船舶登记制度,包括我国船舶登记制度、关于船舶登记的国际公约、马恩岛船舶海外登记制度、挪威国际船舶登记制度。第三章主要论述了洋山保税港区建立第二船籍登记制度的可行性,包括我国国际航运船舶状况、洋山保税港区建立第二船籍登记制度的意义。第四章主要论述了洋山保税港区建立第二船籍登记制度的相关法律问题,包括洋山保税港区的法律环境初探和建立第二船籍登记制度的立法建议。
Secondary Registry is a new type of the Ship Registry nowadays, which has its own system on the terms of ship registration, the collection of taxes and fees of ship, the terms of the equipment of crewmembers, and the application of Safe Criteria. So it is different from Open Registry and Close Registry. Constituted by governments of flag, it is carried with original system of the Ship Registry at the same time. Practice on conventional marine countries has proved Secondary Registry is a effective system of ocean shipping, which do good deal with the safety of life on the sea, the economic development of shipping, the protection of the environment of sea, and so on.
     In order to accelerate the economic development of shipping, we should reform the configuration of shipping industry in our country. Secondary Registry can mend shortcomings carried by Open Registry and Close Registry, and can adjust the structure of shipping. It’s an effective assurance of law system on innovation of shipping industry in our country. The first-phase project of Yangshan Deepwater Port Area, the core project of Shanghai International Shipping Center, was completed and opened on Dec. 10th, 2005. The bonded port area was launched at the same time. All of these supply advantageous condition for us to set up Secondary Registry in Yangshan bonded port area.
     This thesis is composed of four chapters. The chapter one mainly introduces the form and development of Secondary Registry, including the summary of the Ship Registry, the form and development of Secondary Registry, and the reason of the form of Secondary Registry. The chapter two mainly expatiates on correlative law system of the Ship Registry in China, United States, and foreign countries. The chapter three mainly analyzes feasibility of setting up Secondary Registry in Yangshan bonded port area, included the existing state of international shipping in our country and the significance of establishment of Secondary Registry in Yangshan.
