空间权制度研究

摘要
现代社会,有限的地表资源已经无法满足人类生产生活的需要,迫切需要对空间进行开发利用,空间权制度随之在一些国家和地区建立起来。但我国目前还没有建立起符合我国需要的空间权制度。本文即是在我国国情基础上,对建立有中国特色的空间权制度进行探讨和研究。
本文共分四个部分。第一部分主要介绍空间权的概念及产生,并通过对各国和地区空间权制度的比较分析,着重探讨空间权的基本理论;第二部分主要是空间权与相关物权之区别,以确立空间权独立的法律地位;第三部分着重介绍空间权制度的社会价值;第四部分主要研究在我国如何构建有中国特色的空间权制度,提出空间权客体的空间不但应包括城市空间还应包括农地空间,并主张无论城市空间还是农地空间其所有者只能是国家的观点。
In modern society,the litimation of the earth's surface makes mankind get in urgent need of developing and utilizing space,the system of air rights has been established successively in some countries and districts.But,in our country,the system of air rights has not been established.This article is about the air rights system with Chinese characteristic established in our country.This article consists of four parts.The first part simply introduces the origin and development of the air rights,then probes into some basic theoretical matters through comparative study on the system of the air rights in some countries.The second part mainly analyzes the differences of the air rights and the real rights.The third part mainly analyzes the value of the system of air rights.The least part mainly studies the problems of the air rights system with Chinese characteristic established in our country,and raises that object of real rights should include not only the city's space but the country's space as well.It also advocates that both the city's space and country's space should belong to the nation.
本文共分四个部分。第一部分主要介绍空间权的概念及产生,并通过对各国和地区空间权制度的比较分析,着重探讨空间权的基本理论;第二部分主要是空间权与相关物权之区别,以确立空间权独立的法律地位;第三部分着重介绍空间权制度的社会价值;第四部分主要研究在我国如何构建有中国特色的空间权制度,提出空间权客体的空间不但应包括城市空间还应包括农地空间,并主张无论城市空间还是农地空间其所有者只能是国家的观点。
