滥用职权罪若干问题研究

摘要
本文共分五部分。引言对滥用职权罪的概况及写作此文的动因作了简要介绍，并说明了本文的构思。正文着重就滥用职权罪的立法沿革、构成特征、司法认定及立法完善，分四个部分进行了论述。
一、滥用职权罪的立法沿革与现状。从历史的视角就滥用职权罪在中国不同历史时期的状况、立法沿革作了回顾。
二、滥用职权罪的构成特征。着重从犯罪构成的四个方面对滥用职权罪的概念、特征进行了论述。特别是对滥用职权罪侵犯的客体、犯罪行为的作为方式、如何认定经济损失以及追诉时效等在理论界和司法部门引起争议的问题提出了自己的看法。
三、滥用职权罪的司法认定。就滥用职权罪的罪与非罪的界限，滥用职权罪与其它几个易混淆的犯罪的区别进行了论述。
四、滥用职权罪的立法完善。运用法学理论，结合司法实践中出现的问题，对进一步完善滥用职权罪立法进行了探讨。
This article is divided into five parts. The foreword introduces briefly the general situation of the crime-the abuse of authority ,the motive for this article and explains the construction of this article. The text emphasizes this crime's history in legislation, characters of constuction, determination and consummation legislative, separately in four parts.
Firstly, this crime's history in legislation and status quo. It is discussed by looking back its situation in different epochs in the sight of history.
Secondly, this crime's characters of construction. It is demonstrated from four aspects, especially bringing forward the author's point of view in the aspects which have been disputed in the group theoretical and practical, such as its object, its manner of action and how to identify the economic loss, how to ascertain the limitation period for prosecution.
Thirdly, the crime's determination judicial. It demonstrates the difference between crime and illegal act, and the difference between this and other crimes.
Fourthly, consummation legislative. It probes into how to perfect the law by using theories of law, combing the practice.
