中国孵化器法律保障问题研究
摘要
随着经济的快速发展,科技企业孵化器的数量快速增长,在许多地方,孵化器引领了新兴产业,吸引了大量高科技人才特别是留学人员回国创业。加速科技成果转化、鼓励高层次人才就业、培育中小型科技企业、振兴区域经济、推动社会经济发展发挥着重要的作用。本文主要阐述了我国科技企业孵化器作为现代社会科技创业者的创业活动新型的经济组织,其产业化发展之路是非常重要的。随着孵化器的发展和运营,一些问题也随之暴漏,为了促进科技企业孵化器能快速的发展,必须在法律方面给予一定的支持和保障。
本文从案例分析、制度学及新制度经济学等方面进行了研究,从孵化器在融投资、税收、科技成果转化、知识产权保护等方面进行了阐述,为我国的法律领域在保护科技企业孵化器的发展提供一定的借鉴。本文以“中国孵化器法律问题研究”为题,旨在建立一个适宜的分析框架,探索促进科技企业孵化器产业化发展过程中有效政策和法律制度的安排。对科技企业孵化器发展过程中的政策、法律制度问题进行思考,有助于我们发现高科技时代产业化实现的经济形式,认识高技术产业创新的基本规律,而且也为各个地区和国家提供一种促进科技企业孵化器产业创新的政策依据提供保障。由于科技企业孵化器是一种新型的经济组织,提供了科技成果转化和创业行为扩散的动力,形成了一种有益于知识经济成长的社会组织形式,因此,本文的研究也为知识经济的发展探索出一种有效的社会体制。
With the rapid economic development, science and technology business incubators in the number of rapid growth, in many places, the leading incubator of new industries, attracting a large number of high-tech talent, especially entrepreneurial students to return. Accelerate the transformation of scientific and technological achievements, to encourage high-level talent and nurture small and medium-sized enterprises to revitalize the regional economy, socio-economic development plays an important role. This paper elaborated on China's science and technology business incubators as a modern society, science and technology entrepreneurs in the entrepreneurial activities of new economic organizations, the industrial development of the road is very important. With the development of incubators and operating, some storm drain issues also, in order to promote science and technology business incubators to the rapid development of the legal aspects must be given some support and protection.
In this paper, case studies, school system and the new institutional economics and other aspects of the research, from the incubator in the financial investment, taxation, science and technology achievements, intellectual property protection and other aspects of the elaboration of the legal field for China's science and technology in the protection of business incubators development to provide a reference. In this paper, "China's incubator study the legal issues" in the title to establish a suitable analytical framework, and explore science and technology business incubators to promote industrialization in the development of effective policies and arrangements for the legal system. Science and technology business incubators in the development of policy, legal system to think, help us to find high-tech era of the industrialization of the economy to achieve the form of high-tech industry understand the basic rules of innovation, but also for the various regions and countries to provide a the promotion of science and technology business incubators and innovation policy based on industry to provide protection. As the technology business incubator is a new kind of economic organizations, to provide scientific and technological achievements and entrepreneurial behavior into the spread of power, the formation of a knowledge-based economy the growth of beneficial forms of social organization, therefore, for this study to explore the development of a knowledge-based economy an effective social system.
本文从案例分析、制度学及新制度经济学等方面进行了研究,从孵化器在融投资、税收、科技成果转化、知识产权保护等方面进行了阐述,为我国的法律领域在保护科技企业孵化器的发展提供一定的借鉴。本文以“中国孵化器法律问题研究”为题,旨在建立一个适宜的分析框架,探索促进科技企业孵化器产业化发展过程中有效政策和法律制度的安排。对科技企业孵化器发展过程中的政策、法律制度问题进行思考,有助于我们发现高科技时代产业化实现的经济形式,认识高技术产业创新的基本规律,而且也为各个地区和国家提供一种促进科技企业孵化器产业创新的政策依据提供保障。由于科技企业孵化器是一种新型的经济组织,提供了科技成果转化和创业行为扩散的动力,形成了一种有益于知识经济成长的社会组织形式,因此,本文的研究也为知识经济的发展探索出一种有效的社会体制。
