湖北省商标战略研究

摘要
随着知识经济时代的到来和经济全球化和一体化的深入,许多国家纷纷制定和实施知识产权战略来发展经济或者维护其竞争优势。我国也发布了《国家知识产权战略纲要》,提出了商标专项任务,国家工商总局出台了《关于贯彻落实(国家知识产权战略纲要)大力推进商标战略实施的意见》,并多次召开会议来推动商标战略和商标事业的发展,部分省市自治区也积极开展了地方知识产权战略制定和实施工作。在此背景下,湖北省商标战略的研究和制定实施具有紧迫性和重要性。湖北省商标战略是促进湖北省可持续发展、建设创新型湖北的客观要求;是促进湖北省经济、科技、社会发展的有效手段;是加快湖北省经济增长方式转变,发展特色经济、区域经济和加快社会主义新农村建设的必然抉择;同时也是实施国家知识产权战略的迫切需要。
     为了利用湖北省自身优势,抓住发展机遇,尽量避免威胁,因地制宜地制定了湖北省商标战略。本文在深入调查研究湖北省商标现状的基础上,总结湖北省商标取得的成绩和商标事业发展中的不足,并运用SWOT分析湖北省发展商标战略的优势与劣势,分析湖北省发展商标战略中外部环境存在的机会和挑战。在湖北省商标战略指导思想下,立足省情,追踪国内外市场和近期目标与长远目标相结合,突出重点,彰显湖北省商标战略特色等原则的基础上提出湖北省商标战略实施的具体措施和长远目标。
     本文提出首先要全面完善湖北省商标法律法规体系,推进全方位商标政策体系构建,完善商标协调激励机制和各项促进政策;其次要创新和完善商标管理体制机制,实现湖北省商标管理的统筹兼顾和协调发展;再次推进湖北省企业商标注册战略和企业商标运用和保护战略,充分发挥农产品商标和地理标志在统筹城乡发展和新农村建设中的推动作用,规范发展商标中介服务体系,加快商标注册管理与公共服务信息化建设,加大商标宣传教育力度,提高全社会的商标与品牌意识;最后要大力培养各类商标专业人才,为商标战略提供智力支持。并结合国家商标战略总体规划,到2020年,提出把湖北省建设成为商标注册、运用、保护和管理水平较高的省份。
With the advent of the era of knowledge economy and the deepening of economic globalization and integration, many countries have to develop and implement intellectual property strategies to maintain their competitive advantage. Our country also issued the "Outline of National Intellectual Property Strategy", the special task of the trademark, the State Administration for Trade and Industry issued a "Circular on implementing the" Outline of National Intellectual Property Strategy "implementation of the strategy and vigorously promote the views of trade mark", and held several meetings to to promote the development of trademark strategy and brand cause, some provinces are also active in doing this. In this context, it's urgent and important for Hubei to research trademark strategies and take some measures. It is objective demand to promote sustainable development and innovation-based requirements in Hubei Province, and it is effective means to promote the development of Hubei Province's economic, technological and social; and it accelerate the transformation of economic mode, develop distinctive economy, regional economy and accelerate construction for new countryside. It is also an urgent need to implement the national intellectual property strategy.
     To take advantage of their own advantages in Hubei Province, and seize the development opportunity as far as possible to avoid the threat, according to local conditions to formulate strategy in Hubei trademark. This paper sum up the achievements and the lack in the trademark development after the deep investigations on the basis of the status quo in Hubei trademark, and using SWOT to analyse strategy and weaknesses in Hubei Province, and get opportunities and challenges exist outside of the environment,, under the guiding ideology, the trademark strategy in Hubei Province based on situation in the province, tracking domestic and international markets and short-term goals and long-term goals, showing the characteristics of Hubei Province, put out strategy and long-term goals based on the the principles of trademark strategy
     In this paper, first we must fully complete trademark legal system in Hubei Province to promote comprehensive trademark policy system construction, and improve the coordination and incentive mechanisms policy. Second, innovate and improve brand management systems and mechanisms to achieve integrated management so the trademarks and coordinated development can make it, once more push forward the strategic and business trademark registration strategies, give full play to trademarks and geographical indications for agricultural products in co-ordinating urban and rural development and new rural construction in the catalytic role. Regulate the trademark intermediary service system, and speed up the trademark registration management and public services construction, raising the public awareness of trademark and brand. Great efforts to train all kinds of trademark professionals to provide intellectual support for the trademark strategies. National trademark in conjunction with the strategic master plan. Until 2020, the Hubei Province will become to a province with a high level of a trademark registration, use, protection and management.
