摘要

作为环境民事公益诉讼的公益起诉人及行使检察权的国家机关,检察院在环境民事公益诉讼中既具有公益诉权,也具有协助执行权。检察机关应对环境民事公益诉讼裁判的执行进行检察监督。"双重目的论"下环境民事公益诉讼执行检察监督的主要职能是解决执行难、执行乱的问题,其监督对象及其范围相较于私益诉讼而言有所拓展,监督方式则具有多样性与裁量性。
        As a public prosecutor in environmental civil public interest litigation and a state organ exercising procuratorial power, the procuratorate has both public interest litigation right and assistant execution right in environmental civil public interest litigation. The procuratorial organs shall supervise the execution of environmental civil public interest litigation judgments. The main function of procuratorial supervision in environmental civil public interest litigation under the dual purpose theory is to solve the problems of difficult execution and disorderly execution. The object and scope of supervision are expanded compared with private interest litigation, and the ways of supervision are diverse and discretionary.
