我国GUI外观设计专利研究

摘要
随着近年来电子科技的浪潮式发展,对于GUI(Graphical User Interface用户图形界面)外观设计保护的呼声愈发高涨。2014年国家知识产权局颁布的《第六十八号令》中纳入GUI外观设计保护范围之后,2017年12月,被誉为国内用户图形界面第一案的"360公司诉江民侵害外观设计专利权纠纷案"尘埃落定。在法律实践中,体现着对GUI外观设计的思考。面对GUI外观设计保护,从用户图形的起源说起,对世界上主要国家的不同保护制度进行归纳,并结合学界对于GUI外观设计的不同看法,探析未来我国在用户图形界面外观设计中的方向选择。
With the development of electronic technology in recent years,the call for the protection of GUI design has become more and more popular.After the inclusion of the scope of GUI design protection in the"Article 68"promulgated by the National Intellectual Property Administration,PRC in 2014,in December 2017,the360 company v.Jiangmin infringement design patent was praised as the first case of the domestic user's graphical interface.The dispute of power has also been settled.A series of legal practices all reflect the thinking of GUI design.In the face of the crossroads of GUI design protection,this article starts from the origin of user graphics,summarizes the different protection systems of major countries in the world at the present stage,and combines the different views of GUI in China's current academic circles to analyze the future.The choice of direction in the design of the user's graphical interface.
