摘要

专利审查是一项行政工作,由于其审查性质的准司法性,如何运用证据进行审查显得尤为重要。正确运用证据是依法审查的具体表现形式,也是专利审查工作的基础和前提。为了说明证据意识在创造性评判中的重要性,以救生领域正反的两个实际案例为例,分析了证据在评判专利申请创造性时发挥的作用。
        Patent examination is an administrative work. Evidence examination, with the element of quasi-judicial government, is particularly important.Correctness of evidence is not only the concrete manifestation of legal examination, but also the basis and premise of patent examination. In order to illustrate the importance of evidence awareness in improving the efficiency of the creative judgement, the role of evidence in judging the creativity of patent applications is analyzed by taking two cases in the field of life-saving as examples.
