司法精神医学鉴定117例案例分析

摘要
目的研究我市2014年-2016年的117例司法精神医学鉴定案例的特点和一般规律。方法采用自编调查表,对117例司法精神医学鉴定案例资料进行回顾性研究。结果被鉴定人以男性、青壮年、低文化程度的无业人员及农民为主,案件类型涉及24类,以故意伤害26例(22.22%),故意杀人21例(17.95%),强奸15例(12.82%),盗窃10例(8.55%)案例居多;鉴定诊断结果排序前五位依次为精神分裂症39例(33.33%),精神发育迟滞22例(18.80%),无精神病18例(15.38%),脑外伤所致精神障碍8例(6.78%),双相障碍6例(5.13%),在刑事责任能力鉴定中,判定无责任能力、部分责任能力和完全责任能力,分别占被鉴定人数的26.44%、34.48%、39,08%。民事行为能力鉴定中以离婚案例和财产继承的案例较多。结论宝鸡市司法精神医学鉴定疾病诊断排序前三位的是精神分裂症、精神发育迟滞、无精神病。司法精神病学鉴定的服务对象逐渐多样化,服务范围由从刑事法律服务向兼顾民事扩展。
Objective To study the characteristics and general rules of 117 cases of forensic psychiatric authentication in Baoji city from 2014 years to 2016 years. Methods This is a retrospective study of 117 cases analysis of forensic psychiatric authentication,which makes use of self-questionary. Results The majority of identified people are males,young adults, unemployed people of low education level and farmers,the types of cases involving 24, crime of intentional injury has 26 cases(22.22%),crime of intentional homicide has 21 cases(17.95%), offense of rape has 15 cases(12.82%), larceny has 10 cases(8.55%) accounts for more heavy.Top five of identification result rank in turn are schizophrenia has 39 cases(33.33%),mental retardation has 22 cases(18.80%),orthophrenia has 18 cases(15. 38%), psychogeny is caused by brain injury 8 cases(6. 78%), bipolar disorder has 6 cases(5. 13%). In criminal capacity authentication determined that there is irresponsibility, Partial responsibility and complete capacity for responsibility, which are respectively the 26.44 %,the 34.48,39.08 % of the number of identification. There are many cases of divorce cases and inheritance of property in capacity for conduct. Conclusion the top three diseases in Baoji city forensic psychiatric authentication diseases are schizophrenia, mental retardation, and orthophrenia. The service object of forensic psychiatry is gradually diversified, and the scope of service is from the criminal law service to the balance civil.
