摘要
国家治理体系与治理能力现代化的实现要以制度为依托,人事管理制度是国家机器运转的关键环节,关系到政府的社会治理能力和效率。政府雇员制作为对政府人事管理制度的一次探索,对我国传统公务员制度的一种创新,把市场用人机制引入政府机构,在一定程度上有利于推动政府依法高效行政。但自政府雇员制改革推行以来,实施效果却并不令人满意。在政府机构改革的关键时期,针对政府雇员制推行过程中存在的法律依据缺失、配套制度不完善、实施缺乏推动力、合同管理约束性差等问题,应当从深入政府雇员制理论研究、完善相关法律法规建设及管理制度、加大政府雇员制度推行力度、明确政府雇员的权责利、理顺制度与制度及人与人之间的关系等几个方面着手进行改进。
        Modernization of national governance system and governance capacity should be based on system building. The personnel management system is a key link in the operation of the state machinery and is related to the government's social governance ability and efficiency. As an exploratory attempt to improve the current government personnel management system, the government employee system is an innovation to the traditional civil service system of China, whereupon the introduction of a market-based employment mechanism into government agencies is to some extent conducive to promoting the efficiency of government administration according to law. However, since the inception of the government employee system reform, the implementation effect has not been satisfactory, and the implementation of this system has produced different results. In the critical period of government institutional reform, such problems as lack of legal basis, imperfect supporting systems, lack of impetus for implementation and poor binding force of contract management should be addressed without delay. Meanwhile, resolution of the above-mentioned problems and further reform initiatives should proceed from the following: enhancing theoretical research on government employee system, improving relevant laws and regulations and management system, strengthening the implementation of the government employee system, clarifying the rights, interests and obligations of government employees, as well as coordinating and rationalizing system-to-system and people-to-people relationships.
