体育强国背景下体育法治发展的问题及路径选择研究

摘要
文章采用文献资料法、逻辑分析法等方法,在体育强国背景下,强调体育法治建设的必要性,分析体育法治发展的问题,包括公共体育服务的立法、体育社会组织改革发展和管理的立法、青少年学校体育的立法、体育活动与赛事监管的立法、运动员权益保障的立法、体育产业相关问题的立法等问题。提出提升体育法治发展的路径,包括提升体育行政部门法治能力、推进体育社团组织实体的规范治理、拓宽体育案件裁决的司法体系、构建专门体育仲裁的机构模式、争夺体育法学领域的话语权等。旨在为体育法治建设,以及体育事业改革与发展提供理论建议,助力"健康中国"与"小康中国"战略实践。
This paper analyzes the necessity of the construction of sports rule of law, including the legislation of public sports service, the legislation of sports social organization reform and management, the legislation of youth school sports, the sports in the field of sports power, emphasizes the necessity of sports rule of law construction under the background of sports power activities and the regulation of the activities of the legislation, the protection of the rights and interests of athletes legislation, sports industry-related issues such as legislation.The paper puts forward the path of promoting the construction of the rule of law in the sports, including the ability to promote the rule of law in the sports administrative department, the standardization of the organization of the sports community, the judicial system of the sports case ruling, the institutional model of special sports arbitration, and the right of discourse in the field of sports law.It aims to provide theoretical suggestions for the construction of sports rule of law and the reform and development of sports undertakings, and to help the practice of "healthy China" and "well-off China".
