论证据的客观性与真实性——以事实信息为视角

摘要
证据属性问题是证据法学体系中基础性的理论问题。证据的客观性与真实性二者既有联系又有区别,二者都必须以客观存在的证据为前提,不以人的主观意志为转移。证据属性是证据自身的本质属性。证据不可能自己判断自己是否"真实",但证据可以并且应当是客观的。"真实"与否是人对证据的判断,判断的结果是"真"是"假",属于证据运用层面,而非证据自身的本质属性。
The problem of evidence attribute is a basic theoretical problem in the system of evidence law.The objectivity and authenticity of evidence have both relations and differences,both of them must take the objective reality of evidence as the premise,not the subjective will to transfer. The evidence attribute is the essential attribute of the evidence itself. It is impossible for the evidence to judge whether it is "true" or not,but the evidence can and should be objective. Whether "true" or not is human's judgment of proposition,and the result of judgment is "true" or "false",which belongs to the level of evidence application rather than the essential attribute of evidence itself.
