摘要
流失海外档案文献的追索是近年来档案界关注的热点问题之一。运用替代性纠纷解决机制追索流失海外档案文献相较条约法框架下的公法路径更具约束力,相较跨国民事诉讼的私法路径更具执行力。通过分析WIPO-ICOM艺术与文化遗产纠纷调解规则的适用范围和调解程序可以看出,运用调解、仲裁等替代性纠纷解决机制追索档案文献等文化遗产不失为一种新思路。为此我国应该主动了解国际替代性纠纷解决机制及相关实践,加强整合我国流失海外文化财产追索资源,并主动参与替代性纠纷解决机制建设。
The retrieving of the archives lost overseas is one of the hot issues in the archives circles in recent years. The use of alternative dispute resolution mechanisms to pursue the loss of overseas archives is more binding than the public law path under the framework of treaty law, and is more enforceable than the private law path of transnational civil litigation. By analyzing the scope of application and mediation procedures of the WIPO-ICOM Art and Cultural Heritage Dispute Mediation Mechanism, it can be seen that the use of alternative dispute resolution mechanisms such as mediation and arbitration to pursue cultural heritage such as archives is a new idea. To this end, China should take the initiative to understand the international alternative dispute resolution mechanism and related practices, strengthen the integration of China's lost overseas cultural property resources, and actively participate in the construction of alternative dispute resolution mechanisms.
