摘要
随着计算机技术发展,越来越多的眼科方法基于计算机技术实现。对于基于计算机技术的眼科方法,是否属于专利法意义上的疾病的诊断方法一直是困扰本领域人员的难点。本文在梳理我国关于疾病的诊断方法的规定的基础上,对四个典型案例进行分析,进而总结对这类申请的判断标准,以提供眼科领域研究人员一些参考。
With the development of computer technology, more and more ophthalmic methods are realized based on computer technology. As for the ophthalmic methods based on computer technology, whether they belong to the diagnosis methods of diseases in the sense of patent law has always been a difficult problem for researchers in this field. On the basis of combing the provisions on the diagnosis methods of diseases in China, this paper analyzes four typical cases, and then summarizes the judgment criteria for such applications, so as to provide some references for researchers in the field of ophthalmology.
